Designing a UK Six-Month Probation Calendar Around the ERA 1996 s. 97(2) EDT Trap
Paying in lieu of notice at five months and three weeks does not freeze continuous service. Under ERA 1996 s. 86 and s. 97(2), statutory notice pushes the Effective Date of Termination across the 1 January 2027 unfair-dismissal threshold.
- Jurisdiction
- Great Britain · ERA 1996 ss. 86, 97(1)–(2), 108 & ERA 2025
- Employer threshold
- 6 months continuous service (minus 7-day s. 86 statutory notice extension)
- Decision trigger
- Probation review, probation extension request, or PILON dismissal between Month 4 and Month 6
- Review cadence
- Reviewed on ERA 2025 statutory probationary period regulations or Supreme Court/EAT EDT rulings
Direct operational answer
Under Employment Rights Act 1996 sections 86(1)(a) and 97(2), dismissing a UK employee with one month or more of service without notice—or via Payment in Lieu of Notice (PILON)—extends their statutory Effective Date of Termination by one full week. Under the hr.cafe Week-20 probation calendar, HR completes final probation decisions at least 14 days before the six-month mark and serves written notice in person to satisfy Gisda Cyf v Barratt [2010] UKSC 41.
How ERA 1996 Section 97(2) Defeats Last-Week PILON Exits
Across UK HR teams, the single costliest operational habit carried over from the two-year era is scheduling the "six-month probation review" inside the final week of Month 6. From 1 January 2027, that calendar habit hands failed probationers uncapped unfair-dismissal standing.
Trace the statutory mechanics step by step. Under the Employment Rights Act 2025 implementation schedule, ordinary unfair-dismissal eligibility drops from two years to six months' continuous employment for dismissals taking effect on or after 1 January 2027, while the statutory cap on compensatory awards disappears simultaneously. Whether an employee has accrued six months' continuous employment under ERA 1996 s. 108(1) and s. 211(1) is measured up to the statutory Effective Date of Termination (EDT).
Open Employment Rights Act 1996 s. 97 alongside s. 86(1)(a). Once an employee has been continuously employed for one month or more (up to two years), s. 86(1)(a) entitles them to not less than one week's statutory notice from the employer, absent gross misconduct justifying summary common-law dismissal.
Now watch what happens when a manager invokes a contractual Payment in Lieu of Notice (PILON) clause on Day 178 to exit a struggling new starter "immediately before six months hits":
- Step 1 — Contractual EDT under s. 97(1)(b): Because PILON terminates employment without working notice, the immediate termination date under s. 97(1)(b) is Day 178.
- Step 2 — Mandatory Statutory Extension under s. 97(2): Section 97(2) intervenes as an anti-avoidance rule for unfair-dismissal qualifying service (s. 108(1)). Where employment is terminated without notice—or with shorter notice than s. 86 requires—the statutory EDT is deemed to be the later date on which the statutory notice under s. 86 would have expired had it been duly given on the termination date!
- Exact Calendar Arithmetic: Suppose an employee starts work on Monday, 3 August 2026. Under ERA 1996 s. 211, continuous employment starts on 3 August 2026, so six calendar months completes at midnight at the end of Tuesday, 2 February 2027 (reaching six months if employed through 2 February 2027). If you hold a probation dismissal meeting on Wednesday, 27 January 2027 and pay four weeks' contractual PILON immediately, s. 97(2) ignores the four-week contractual period—it adds only the one-week statutory s. 86 notice—pushing the statutory EDT to Wednesday, 3 February 2027. Your dismissed probationer just crossed six months with uncapped unfair-dismissal standing!
Note the sole exception in s. 86(6): if the employee committed genuine, proven common-law repudiatory gross misconduct entitling the employer to terminate summarily without notice, s. 97(2) does not add the statutory week (Lancaster University v College Union / Duniec v Travis Perkins Trading Co Ltd [2014] UKEAT). Poor sales numbers, slow ramp-up, or missed deadlines are capability issues—never gross misconduct—so s. 97(2) always adds seven days.
The Gisda Cyf Notice-Receipt Trap for Remote and Hybrid Staff
Mailing or emailing a termination letter on the last safe afternoon does not start the notice clock until the employee actually reads it or has a reasonable opportunity to do so. One unread weekend email shifts your EDT across the six-month cliff.
Even HR teams who remember the seven-day s. 86 buffer get caught by UK Supreme Court rules on when notice starts to run. In Gisda Cyf v Barratt [2010] UKSC 41 and Newcastle upon Tyne Hospitals NHS Foundation Trust v Haywood [2018] UKSC 22, the Supreme Court confirmed that commercial postal rules do not govern statutory employment termination. Written dismissal or notice takes effect only when it is actually communicated to and read by the employee (or when the employee has had a reasonable opportunity to read it and has not deliberately evaded delivery).
Trace how Haywood and Gisda Cyf ambush a hybrid UK workplace in 2027:
- First-class post during annual leave: You post a probation failure letter on Thursday, Day 171, while the employee is away in Spain on approved four-day leave. Royal Mail delivers it on Saturday, Day 173, and she opens it on Monday evening, Day 175. Add seven days' statutory notice under s. 86/s. 97(2) (noting also that when working notice is given, the day on which notice is given is excluded from the clear seven-day count under West v Kneels Ltd [1986] ICR 640!). Her EDT lands past six months.
- Deactivated laptop before personal email delivery: IT locks a remote engineer's corporate Microsoft 365 account at 16:45 on Friday during the exit call, then HR emails the written PILON confirmation only to the deactivated work address—discovering the bounce on Tuesday morning. Oral dismissal in the video call starts the clock only if unambiguous ("your employment ends today, Friday 22 January"); any ambiguous phrasing ("HR will send paperwork next week confirming next steps") pushes the EDT onto Tuesday's email receipt!
- Longer working contractual notice vs. PILON: If an executive's contract requires one month's working notice during probation and you ask them to work that month starting at Month 5 Week 1, their actual worked EDT under s. 97(1)(a) runs all the way to Month 6 Week 1—handing them unfair-dismissal rights! Conversely, if you exercise a cleanly drafted contractual PILON clause at Month 5 Week 1 (say Day 155), actual employment ends on Day 155 and s. 97(2) adds only the one-week statutory s. 86 notice (Day 162)—safely below six months!
Why "Extending Probation to Nine Months" No Longer Buys Legal Shelter
Extending a contractual probation period from six months to nine months changes internal perks or notice length—it cannot waive Parliament's six-month unfair-dismissal threshold. Any post-six-month exit requires a full ERA 1996 s. 98 capability process.
Every week on UK HR forums, managers ask whether adding a three-month contractual probation extension clause protects the company until Month 9. Under ERA 1996 s. 203(1), any contractual term purporting to exclude or limit the operation of statutory unfair-dismissal rights is void. Once an employee's EDT crosses six months on or after 1 January 2027, calling them a "probationer" in Workday or BambooHR has zero statutory magic (subject to any lighter-touch statutory "initial period of employment" capability procedure once secondary regulations under the Employment Rights Act 2025 are brought into force—until and unless your process satisfies exact statutory regulations, full s. 98(4) procedural fairness governs).
Check Day-1 claim exposure even inside the first 20 weeks too. Dismissing at Week 14 without checking why performance dipped still triggers uncapped Day-1 liability if the dip stems from an unadjusted disability (Equality Act 2010 ss. 15 & 20), pregnancy illness (s. 18), asserting a statutory right (ERA 1996 s. 104), or making a protected whistleblowing disclosure (s. 103A). UK Six-Month Probation Gate & Section 97(2) Last-Safe-Date Calculator
| Milestone Gate | Exact Timing From Start Date | Mandatory Operational Action | EDT / Notice Trap Prevented |
|---|---|---|---|
| Gate 0: Contract Check | Pre-Hire Offer Template | Insert explicit PILON clause + 1-week probation contractual notice during Months 1–6 (rising to 1–3 months only after written confirmation of passed probation). | Prevents 1-month or 3-month worked probation notice from dragging EDT past Month 6 under s. 97(1)(a). |
| Gate 1: Early Signal | Week 8 (~Day 56) | Structured 60-day check-in logging 3 measurable role KPIs, onboarding blockers, and explicit Equality Act s. 20 reasonable-adjustment ask. | Surfaces hidden neurodivergence, health, or tooling gaps early so capability dismissal never masks s. 15 discrimination. |
| Gate 2: Corrective Gate | Week 15 (~Day 105) | Written mid-probation warning if off-track: issue 4-week concrete support plan with weekly 1:1 notes and clear statement that employment is at risk. | Eliminates the "surprise Week-24 manager ambush" where zero contemporaneous evidence exists. |
| Gate 3: Decision Lock | Week 20 (~Day 140) | Mandatory HRBP + Manager pass/fail sign-off. HRIS blocks "extend probation" button unless HR Director signs off on full post-6-month capability ownership. | Leaves a 25-to-35-day safety buffer ahead of the s. 97(2) + Gisda Cyf cliff. |
| Gate 4: Hard Cutoff | 6 Months minus 14 Calendar Days (Absolute Ceiling: minus 9 Days in person) | Hold live meeting, state unambiguous immediate termination via contractual PILON (or serve 1-week worked notice with clear day-count buffer), and hand/personal-email letter with read confirmation. | Absorbs 1 excluded notice-giving day + 7-day s. 86/s. 97(2) statutory extension + 48h Gisda Cyf receipt margin cleanly below 6 months. |

Verify three representative 2026–2027 starter cohorts to see the arithmetic in action:
- Starter A — Joined Monday, 3 August 2026: Six months' continuous employment completes at midnight on Tuesday, 2 February 2027. Absolute statutory cliff with PILON (7 days s. 97(2) extension) requires unambiguous receipt on or before Monday, 25 January 2027 (so s. 97(2) EDT = 1 February 2027, 1 day short of 6 months). hr.cafe Gate 3 Decision Date: Monday, 21 December 2026 (Week 20); Gate 4 Safe Execution Ceiling: Monday, 18 January 2027.
- Starter B — Joined Tuesday, 1 September 2026: Six months' continuous employment completes at midnight on Saturday, 28 February 2027 (reaching 6 calendar months across Sept–Feb). Absolute statutory PILON receipt cliff: Friday, 20 February 2027 (s. 97(2) EDT = 27 February 2027). hr.cafe Gate 3 Decision Date: Tuesday, 19 January 2027; Gate 4 Safe Execution Ceiling: Friday, 13 February 2027.
- Starter C — Joined Monday, 4 January 2027: Six months completes at midnight on Friday, 3 July 2027. Absolute statutory PILON receipt cliff: Thursday, 25 June 2027. hr.cafe Gate 3 Decision Date: Monday, 24 May 2027; Gate 4 Safe Execution Ceiling: Friday, 18 June 2027.

Practitioner questions on the edge cases
If an employee's contract specifies 4 weeks' notice during probation and we pay PILON at 5 months and 10 days, does s. 97(2) add 4 weeks or 1 week?
Section 97(2) adds only the 1-week statutory minimum notice under ERA 1996 s. 86(1)(a)—not the longer 4-week contractual notice period. Provided your contract contains a valid PILON clause and you terminate immediately via PILON at 5 months and 10 days (paying the 4 weeks' money in lieu), the statutory EDT advances by only 7 days to 5 months and 17 days—remaining below six months. Without a PILON clause, or if you require them to work the 4 weeks, actual employment runs past six months.
Does statutory annual leave paid in lieu on termination extend the Effective Date of Termination past six months?
No. Paying accrued untaken statutory holiday pay as a lump sum upon termination under Working Time Regulations 1998 reg. 14 does not extend continuous employment or advance the EDT under ERA 1996 s. 97. Only actual continued employment or statutory minimum notice under s. 97(2) advances the EDT.
What if we dismiss an employee without a PILON clause in the contract and pay damages in lieu?
Terminating immediately without a contractual PILON clause is technically a common-law wrongful dismissal (remedied by paying net notice damages), and under Robert Cort & Son Ltd v Charman [1981] ICR 816, the immediate termination date still stands as the s. 97(1)(b) date—plus the 1-week statutory s. 97(2) extension. However, terminating in breach of contract can invalidate post-termination restrictive covenants under General Billposting Co Ltd v Atkinson [1909] AC 118, making an express PILON clause essential.
Do employees dismissed during probation from 1 January 2027 have a statutory right to written reasons for dismissal?
Only once they reach the six-month continuous service threshold (reduced from two years in tandem with unfair dismissal under the Employment Rights Act 2025), except where the employee is dismissed while pregnant or during statutory maternity or adoption leave, in which case ERA 1996 s. 92(4) mandates written reasons automatically with zero qualifying service and without even needing a request.
